Legal aid is no longer available for personal injury funding. Since conditional fees (No win no fee) agreements were first allowed in 1997, MarstonHarbottle have succeeded in recovering compensation for a considerable number of Clients on this basis. Essentially, the way it works is that we take our fees "at risk". This means that if you do not succeed with your claim, we do not charge you anything for the time we have spent in pursuing your case. If you recover compensation, then we charge you our fees at a higher rate than normal to compensate us on not receiving our fees when we normally would. What we charge is based on the work we have done for you.

In these cases, your only outlay will be the cost of court fees or obtaining medical or engineer's reports or Counsel's opinion and the cost of after the event legal insurance to protect you against any liability for your opponent's costs. In some cases, we can fund the cost of these disbursements, on the basis that you pay these back to us with interest when you recover your compensation.

We also offer conditional or contingent fee agreements in employment cases. Each case is judged on its merits by the conducting solicitor. In these cases, there is no ceiling on what we can charge you for our costs as with personal injury cases, and is subject to you and us agreeing terms.

In all conditional fee situations, we advise Clients to consider whether they would benefit from taking out legal expenses insurance against any possibility of having to pay your opponent's costs.
